Q: Do I need a living trust if I already have a will?
A will is a great option for many clients, but ultimately a will must go through probate to be enforceable.
However, there are clients that would like to avoid probate. A living trust is an option to avoid probate and could be a great tool for long-term incapacity situations.
Q: Can I change my estate plan later?
Absolutely — revocable documents such as wills and living trusts can be amended as life circumstances change. There are certain types of trusts and transfers that are irrevocable, which means the client needs to be well informed prior to making any irrevocable gifts.
Q: Will my heirs face estate taxes?
Texas has no estate tax, and federal estate tax applies only to estates above the federal estate tax exemption (i.e., $15 million in 2026 with the exemption amount indexed for inflation).
